Schedule:

Our one-month call for comments regarding the proposed DLV dates closes
this week. No further comments have been received regarding the DLV 2003
dates.

So, unless there are any objections to doing so, we will consider the
dates (April 22-27) definite and I'll draft a notice to be included in
the next mailing to the masses. Speak now or forever ...

Thanks. If there are no more comments on that, I'll make a HTML version
and get it ready to go.

In that case, let's pencil in golf for Friday morning.

Looks like about any afternoon besides Friday will work for the pool
party, and assuming you want a noonish thing for the SO's, just about
any day will work.

>of course we cannot dual track any of the above

And if nobody plans anything else for those timeslots, they will not be
multi-tracked. :)

Hmmm ... a t* group for users of Linux and other various open-source
software might be a very good idea! :) :) :) :)

But seriously, we did have a suggestion for Red Shoe Night. Maybe a
Purple Dress and Red Hat Night?

If she is interested in helping, please have her send in her e-mail to
this list so we can keep her in the loop regarding what's going on.

>also i will pitch in on some of the local dinner arrangements.

Ok, thanks. For dinner, so far we have tentatively scheduled:

Apr 23 Wed 6:30pm Dinner (Sasha's / Milano's)

Apr 25 Fri after Carluccio's dinner

Apr 26 Sat 8:00pm Buffet dinner, San Remo

If you and/or Leah wouldn't mind making contact with Sasha's and
Carluccio's just to be sure we can get on the calendar early for those
two. For San RemO, all we really have to do is show up.

I'm thinking maybe something like Hamburger Mary's might be a good place
to hold a pre-Pre-DLV dinner on Tuesday. I know we totally buried Milano's
this past DLV and HM's is safe enough for those who are a bit shy and out
in the open enough to avoid claustrophobia by the others.

Did anybody find out if they were still staging meals under the cold air
duct?

Comments?

Ok, it's corrected. :)

2nd Draft:

>>Second draft:
<snip>

>>Conditions Of Participation:
<snip>

>>3. That you agree to attend Diva Las Vegas with the understanding that
>>it is at your own risk, and that DLV organizers, volunteers, and other
>>participants are not responsible if something unexpected or tragic
>>occurs.

>Excellent. Re point 3, did you want to use the dreaded lawyer phrase
>of expressly disclaiming liability. You're saying that already, you
>just don't use that "liability" code word. Remember, IANAL and all
>that.

I am definitely not a lawyer. However I did consult one (who knows who
I am and what DLV is) regarding, among other things, how much personal
risk I'm taking by promoting this thing.

Bottom line is that nothing is without risk, but some of the things he
said included:

. Keep money out of it as much as possible.

. Let people know there is no sponsoring organization.

. Be sure auto insurance covers passengers in a rental vehicle.

. Should an incident occur, the sharks will follow the blood, meaning
they will zero in on those with deep pockets, such as insurance
companies, casinos, etc., and not personal assets unless they are
highly substantial.

He used examples of an auto accident, or an injury on casino property.

Since we're not selling a packaged tour, or acting as an agent for hotel
rooms or air/ground transport, there really is not a contract for
services between DLV and the participant.

The term "contract of adhesion" came up several times, but specifically
in respect to any long-winded disclaimer of the "L word" and such.

I'm trying to remember the exact words he used, but it was to the effect
that a 12 page disclaimer would have negligible effect on preventing or
limiting any liability. He did say that a brief note stating that
participation was at one's own risk would not hurt, but since there is
no contract between the non-organization and the participant, it would
not have any legal meaning except to show intent.

Anyway, IANAL, but I have learned to listen to those who are.

As a digression, there was an on-line discussion recently about whether
IANAL meant I Am Not A Lawyer, or I (am) Anal. :)

Transportation:

>>I don't think we need to get too involved in scheduling rides to the
>>events...... like you said, there weren't any problems last year.

>>Maybe some mention in the rules of participation to the effect that
>>some transportation will be provided on a voluntary basis but generally
>>one should consider making their own transportation plans.

>Let me be Devils Advocate again. What say we just say everyone is
>on their own for transport. If people want to share rides they can
>work that out themselves.

I think it's been agreed several times that people are ultimately
responsible for their own local transportation. We'll have a question
out to the masses this week regarding the shuttle van, and we'll see if
there's any interest. Lacking anybody jumping up and down and cheering,
we can simply clarify that yes, the ultimate responsibility is on the
individual, but that a good-faith ride-share thing will again happen.
