Depends- out of state or even out of county residents are a "Flight
Risk" and might not promise to appear in court.
In Illinois and Florida a simple summons is only issued to those who
reside in the state or in the county.
Also, it is a tool that Law Enforcement Officers use as it's quicker and
more simple to allow them to get back on the street quicker...........
however it's a "TOOL" ...an option and not mandatory.
The Illinois Supreme Court and the Florida Supreme courts only set
guidelines. Local and County jurisdictions can do lesser than what the
Courts mandate but not more severe. Hence summons and tickets.
BUT ?? Who wants to get even one of those that requires a court
appearance at a later date ???
